Three Tier Redressal Machinery 


Hello, guys, this is the last blog post on the chapter consumer protection and I hope you guys enjoy my blog post so without wasting any time let's get started....

The three-tier machinery consist of District forum, State commission and National Commission.

Did you know at present there are 610 district forms and 35 state commissions?

District consumer dispute redressal forum

They are set up by State Government in which district the district form has one president in two members one of whom is female they all are appointed by State Government.

State commission

They are set up by the concerned state government. state commission consists of one President and not less than 2 members one should be female. They are also appointed by the concerned state government.

National commission

National Commission is set up by the central government. It consists of women president in not less than 4 members. One of whom should be women. they all are appointed by the central government.

District Commission Process


  • A complaint can be filled in a district forum when the value of goods and service along with compensation claim doesn't cross rupees 20 lakh.
  • On receiving the complaint the district forum shall refer the complaint to the party against whom is filled.  If you require the good or sample thereof shall be sent for testing. The district forum shall pass the order after considering the test report from lab and hearing to the party against whom the complaint is filled.
  • If a consumer is not satisfied with the order of district forum escalate is the case to the state commission within 30 days.

State Commission Process


  • A complaint can be filled in a state commission when the value of goods and service along with compensation claim is between rupees 20 lakh to 1 crore.
  • On receiving the complaint the state commission shall refer the complaint to the party against whom is filled.  If you require the good or sample thereof shall be sent for testing. The state commission shall pass the order after considering the test report from lab and hearing to the party against whom the complaint is filled.
  • If a consumer is not satisfied with the order of state commission escalate his the case to the national commission within 30 days.

National Commission Process


  • A complaint can be filled in a national commission when the value of goods and service along with compensation claim cross rupees 1 Crore.
  • On receiving the complaint the national commission shall refer the complaint to the party against whom is filled.  If you require the good or sample thereof shall be sent for testing. The national commission shall pass the order after considering the test report from lab and hearing to the party against whom the complaint is filled.
  • If a consumer is not satisfied with the order of national commission escalate his the case to the supreme court within 30 days.

Remedies available to consumers


  • To pay any amount (not less than 5% of the value of defective good) to be credited in consumer welfare fund to be utilised for promotion and protection of consumer interest.
  • To remove the defect or deficiency in service.
  • To replace the defective good with a new one.
  • To refund the price paid for the commodity.
  • To pay any reasonable amount of compensation for any injury or loss suffered by the consumer.
  • To pay the adequate cost.
  • To cease the manufacture of hazardous good and stop from offering has hazardous services.
  • Not to offer hazardous goods for sale
  • To withdraw hazardous goods from sale.
  • To discontinue unfair, restrictive trade practices and not to repeat in future.
